On September 1, 2020, the CDC issued an order temporarily halting residential evictions which will remain in effect through December 31, 2020. Under the order, a landlord may not evict any “covered person,” which may mean someone who is unable to make rent payments or find alternative housing options, and the person has made best efforts to obtain all available government assistance for rent or housing.
There are a few important factors to note regarding this order:
- It only applies to Residential properties, but does not include any hotel, motel or other guest house rented to a temporary guest or seasonal tenant.
- It does not include foreclosure on a home mortgage.
- It does not prevent Landlords from charging fees, penalties or interest as a result of the failure to pay rent.
